EVICAM® Terms & Conditions

Introduction and Acceptance

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and ZDTech LLC, a Delaware corporation located at 16192 Coastal Hwy, Lewes, Delaware US 19985 (“Company,” “we,” “us,” or “our”) governing your access to and use of the EVICAM® mobile application, website, and related services (collectively, the “Service”).

By creating an account, downloading, installing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our End User License Agreement. If you do not agree to these terms, you may not access or use the Service.

Eligibility and Account Requirements

To use the Service, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Provide a valid phone number for account verification
• Have the legal capacity to enter into binding agreements
• Comply with all applicable laws and regulations
• Not be prohibited from using the Service under applicable law

You are responsible for maintaining the confidentiality of your account credentials, including your private encryption keys, and for all activities that occur under your account. You agree to notify us immediately at support@evicam.app of any unauthorized use of your account.

Description of Service

EVICAM® provides a secure platform for creating, storing, and sharing verified media content. Key features include:

• Verified Media Capture: Create photos and videos with embedded cryptographic verification metadata including location, timestamp, and device information
• Local Storage: Store verified media locally on your device with no server storage unless explicitly shared
• End-to-End Encrypted Sharing: Share media securely through encrypted chats or password-protected web links
• Zero-Knowledge Architecture: Your private keys remain exclusively on your device, ensuring we cannot access your encrypted content
• Contact Integration: Synchronize with device contacts for easy sharing (processed in-memory only, never stored on servers)
• Token-Based Economy: Use tokens for additional sharing capabilities beyond free limits

Acceptable Use Policy

You agree to use the Service responsibly and lawfully. You may not use the Service to:

• Illegal Activities: Violate any applicable laws, regulations, or third-party rights
• Harmful Content: Share content that is defamatory, harassing, threatening, hateful, or promotes violence
• Inappropriate Content: Upload, share, or distribute sexually explicit content, especially involving minors
• Intellectual Property Infringement: Share content that infringes copyrights, trademarks, or other intellectual property rights
• Privacy Violations: Share private information of others without consent
• Spam or Abuse: Send unsolicited communications or abuse the sharing features
• Security Threats: Attempt to hack, reverse engineer, or compromise the Service’s security
• False Information: Deliberately share misleading or false information presented as verified

We reserve the right to investigate violations, remove content, suspend or terminate accounts, and cooperate with law enforcement as appropriate.

Content Ownership and Licensing

Your Content: You retain full ownership of all verified media content you create using the Service (“Your Content”). You are solely responsible for Your Content and its compliance with applicable laws.

Limited License to Us: When you share content through the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit Your Content solely for the purpose of providing the Service, including:

• Storing shared content in encrypted form on our secure servers
• Facilitating delivery to intended recipients
• Providing web link access with appropriate authentication
• Performing automated content moderation for compliance purposes

Our Content: The Service itself, including software, algorithms, user interfaces, verification technology, and documentation, is owned by ZDTech LLC and protected by intellectual property laws.

Token System and Payments

EVICAM® operates on a freemium model with token-based premium features:

• Free Limits: Limited number of free verified media creations and web shares per day
• Token Purchases: Additional capabilities available through in-app token purchases via Apple App Store or Google Play Store
• Token Usage: Tokens are consumed for premium features including additional media creation, extra web shares, and enhanced sharing options
• No Refunds: All token purchases are final and non-refundable, except as required by Apple/Google policies or applicable law
• Pricing Changes: We reserve the right to modify pricing and limits with reasonable notice

Token balances and transaction records are maintained for service functionality and may be retained for legal and analytical purposes.

Content Moderation and Reporting

To maintain a safe and compliant platform:

• Automated Moderation: Shared content may be subject to automated scanning for prohibited material
• User Reporting: Users can report inappropriate content or behavior
• Human Review: Reported or flagged content may undergo human review
• Content Removal: We may remove, block, or restrict access to content that violates these Terms
• Account Actions: Violations may result in warnings, temporary suspension, or permanent account termination
• Appeals Process: Users may appeal moderation decisions through our support channels

Privacy and Data Protection

Your privacy is fundamental to our Service design. Our zero-knowledge architecture ensures that your private keys never leave your device, and unshared media remains local to your device. Service Availability and Modifications

We strive to provide reliable service but cannot guarantee uninterrupted availability. We reserve the right to:

• Modify, suspend, or discontinue the Service or any features with reasonable notice
• Perform scheduled maintenance and updates
• Impose usage limits or restrict access for technical or security reasons
• Update the mobile application and require users to install updates
• Change pricing, features, or terms with appropriate notice to users

Third-Party Services and Integrations

The Service integrates with third-party services including:

• Cloud Storage: AWS S3 for encrypted shared media storage
• Database Services: Firebase Firestore for encrypted messaging and metadata
• Payment Processing: Apple App Store and Google Play Store for token purchases
• Device Integration: Camera, GPS, and contact access as permitted by device settings

These third-party services are governed by their respective terms of service and privacy policies. We are not responsible for third-party service availability, functionality, or data practices.

Termination

Termination by You: You may terminate your account at any time through the app settings or by contacting support. Upon termination, your access to shared content will be revoked, but local media on your device will remain.

Termination by Us: We may suspend or terminate your account immediately if you violate these Terms, engage in illegal activities, or pose a security risk. We may also terminate the Service entirely with reasonable notice.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. Provisions regarding intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.

Disclaimers and Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR TRADE USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR MEET YOUR REQUIREMENTS. YOU USE THE SERVICE AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZDTECH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless ZDTech LLC, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Service; (b) your violation of these Terms; (c) Your Content or any content you share; or (d) your violation of any third-party rights.

Dispute Resolution and Governing Law

Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Jurisdiction: Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to personal jurisdiction and venue therein.

Limitation Period: Any claim or cause of action arising from these Terms or the Service must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred.

General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and ZDTech LLC regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Assignment: You may not assign these Terms without our written consent. We may assign these Terms at any time without notice.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will:

• Update the “Last Updated” date at the top of these Terms
• Provide notice through the Service or via email for significant changes
• Request your acceptance of updated Terms where required by law

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
