EVICAM® End User License Agreement (EULA)

Introduction

This End User License Agreement (“EULA”) is a legal agreement between you (“User” or “you”) and ZDTech LLC, a Delaware corporation located at 16192 Coastal Hwy, Lewes, Delaware US 19985 (“Company,” “we,” “us,” or “our”) for the EVICAM® mobile application and related services (“App” or “Software”).

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this EULA, our Terms & Conditions, and our Privacy Policy. If you do not agree to these terms, do not install or use the App.

License Grant

Subject to your compliance with this EULA and our Terms & Conditions, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile devices for your personal, non-commercial use only.

This license does not grant you any rights to: (a) use the App for commercial purposes; (b) distribute, rent, lease, lend, sell, sublicense, or transfer the App; (c) copy the App except as expressly permitted; or (d) modify, adapt, alter, translate, or create derivative works of the App.

Software Restrictions

You expressly agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Remove, alter, or obscure any proprietary notices or labels on the App
• Use the App to create competing software or services
• Attempt to circumvent any security measures or access controls
• Use automated tools or bots to interact with the App
• Interfere with or disrupt the App’s functionality or servers
• Use the App for any unlawful or prohibited activities

Intellectual Property Rights

The App and all related intellectual property rights are owned by ZDTech LLC or our licensors. This includes but is not limited to software code, algorithms, user interfaces, graphics, logos, trademarks, and documentation.

You retain ownership of your verified media content created using the App. However, the cryptographic verification technology, metadata embedding systems, and end-to-end encryption implementations remain our proprietary technology.

Third-Party Components

The App may include third-party software components governed by separate license agreements. These components are provided under their respective licenses, and your use of such components is subject to those license terms. We disclaim any warranty or liability related to third-party components.

Updates and Modifications

We may, at our sole discretion, provide updates, patches, enhancements, or modifications to the App (“Updates”). Updates may modify or delete certain features and functionalities.

By continuing to use the App after an Update is made available, you agree to be bound by this EULA as modified by such Update. If you do not agree to the Updated EULA, you must stop using the App.

Data and Privacy

Your privacy is important to us. The App implements zero-knowledge architecture where your verified media files are stored locally on your device and your private encryption keys never leave your device. For detailed information about our data practices, please review our Privacy Policy.

Termination

This EULA is effective until terminated. It will terminate automatically if you fail to comply with any of its terms. We may also terminate this EULA at any time with or without notice.

Upon termination, you must immediately cease all use of the App and delete all copies from your devices. Sections relating to intellectual property, disclaimers, limitations of liability, and governing law shall survive termination.

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZDTECH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Export Control

The App may be subject to export control laws and regulations. You agree to comply with all applicable export and import laws and regulations and will not export, re-export, or transfer the App to prohibited countries or persons.

Governing Law and Dispute Resolution

This EULA is governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from this EULA shall be resolved exclusively in the state and federal courts located in Delaware.

If any provision of this EULA is found to be unenforceable, the remaining provisions shall remain in full force and effect.
